By accessing or using the Building Signal Check tool ("Tool") and any related guidance reports ("Reports") provided by Zion Fire Protection, LLC ("Zion," "we," "us," or "our") through zion.us/bda, bda.zion.us, zionbda.com, ercesauthority.com, or any related domain (collectively, the "Services"), you ("User," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.
The Tool is a free educational screening service designed to help building owners, property managers, design professionals, general contractors, and AHJ representatives in Zion's covered jurisdictions (currently Texas, Florida, California, Arizona, Oklahoma, New York, Illinois, Georgia, North Carolina, Tennessee, Washington, and Colorado, with database depth varying by jurisdiction) understand whether a building may be subject to Emergency Responder Communication Enhancement System (ERCES) applicability criteria under the International Fire Code (IFC) §510, NFPA 1225, NFPA 1, NFPA 72, or related codes as adopted by the local Authority Having Jurisdiction (AHJ).
Important code clarification: Under base 2021 IFC, a building is required to have adequate radio coverage — not necessarily to install an ERCES system. Many buildings have adequate natural coverage and require no installation. An RF site survey per IFC §510.5.3 is the only legally accepted method to determine actual coverage status. Annual signal testing under §510.6.1 applies only to buildings with an installed ERCES system. AHJ-specific local amendments may impose additional obligations.
The Services are NOT:
All Tool output and Reports are courtesy guidance documents only. Final determination of code applicability is made solely by your local AHJ.
To request a Report, you must affirm that you are one of the following with respect to the subject building:
By submitting a request, you affirm under penalty of misrepresentation that one of the above relationships applies. Zion reserves the right, in its sole discretion, to refuse service, withhold a Report, or terminate User access at any time, without explanation. Providing false identity attestation may constitute misrepresentation under applicable law and may result in legal action.
You agree to use the Services only for lawful purposes related to bona fide compliance inquiries. You agree NOT to:

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE TOOL AND ANY REPORT IS AT YOUR SOLE RISK. You assume full responsibility for verifying any code reference, AHJ adoption status, applicability criteria, or compliance pathway shown in the Tool's output by contacting your local AHJ directly. You agree that you will not purchase, design, install, modify, retrofit, or remediate any building system based solely on the Tool's output without first conducting an RF site survey per IFC §510.5.3 by qualified personnel (FCC GROL-licensed and NICET-certified or equivalent) and confirming requirements with your AHJ.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ZION FIRE PROTECTION, LLC, ITS OFFICERS, EMPLOYEES, AGENTS, OR CONTRACTORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES, INCLUDING WITHOUT LIMITATION:

Use of the Services does not create any contractor-client, designer-client, attorney-client, or fiduciary relationship between you and Zion. Reports do not constitute engineering, architectural, or legal services. If you require professional services, please contact Zion at [email protected] to engage us under a written agreement.
Reports are prepared exclusively for the verified User who requested them. Any third party who receives, views, or relies on a Report does so at their own risk and without any express or implied warranty from Zion. Zion is not responsible for any third party's use, redistribution, or commercial exploitation of Report content, including but not limited to use by competing contractors to solicit business from the building owner.
Your use of the Services is also governed by our Privacy Notice, which is incorporated into these Terms by reference.
You agree to indemnify, defend, and hold harmless Zion Fire Protection, LLC and its officers, employees, agents, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your breach of these Terms, (b) your misuse of the Services, (c) any false attestation regarding your identity or relationship to a building, or (d) any third party's reliance on Reports you obtain and redistribute.
Zion may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Sections 4 through 12 and 14 through 19 of these Terms survive termination.
ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES (a "Dispute") SHALL BE RESOLVED EXCLUSIVELY BY FINAL AND BINDING ARBITRATION administered by the American Arbitration Association under its Commercial Arbitration Rules then in effect, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights. The arbitration shall be conducted in Collin County, Texas, in the English language, by a single arbitrator. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
CLASS ACTION WAIVER. You and Zion each agree that any Disputes shall be resolved on an individual basis only, and not as a class action, collective action, mass action, or representative action of any kind. No party may serve as a class representative or class member, and no party may seek non-individualized relief or join or consolidate claims with any other person.
30-day right to opt out: You may opt out of this arbitration agreement by sending written notice within 30 days of first using the Services to: Zion Fire Protection, LLC, Attn: Legal, 3275 N McDonald St, McKinney, TX 75071, or by email to [email protected] with subject line "ARBITRATION OPT OUT." If you opt out, the Governing Law and Venue clause in Section 15 will apply instead.
These Terms are governed by the laws of the State of Texas, without regard to its conflicts-of-law principles. To the extent any Dispute is not subject to arbitration under Section 14 (including injunctive or equitable claims, or where you have validly opted out), it shall be resolved exclusively in the state or federal courts located in Collin County, Texas, and you consent to personal jurisdiction and venue in such courts. You agree not to assert that Texas law is inappropriate even if your building or domicile is located in another state.
To the extent permitted by applicable law, any claim arising out of or relating to these Terms or the Services must be brought within ONE (1) YEAR of the event giving rise to the claim, or be forever barred.
Zion may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Services after a change constitutes acceptance of the revised Terms.
